Feb. 10, 1873 Noah LONG of Grayson Co., VA, to W.D. MAXWELL of Alleghany Co., NC, $20,000 bond, the condition of which is that Noah LONG has a bond against said MAXWELL for $5,000 dated Jan. 4, 1865, & also a deed from the Sheriff of Alleghany Co. dated Aug. 12, 1870 [DB 2:274], for the lands upon which the said MAXWELL & his mother now live, sold to satisfy some executions. Noah LONG agrees to reconvey the land in said deed to MAXWELL when called upon to do so except for one-twelfth of the mineral instead of one-fifteenth as was the former agreement, in consideration for which LONG will have the debts for lands sold to C.H. DOUGHTON for his son J.A. DOUGHTON, & a debt from D.C. JONES upon a compromise in the AUSTIN land suit, except enough out of said debts to pay what said MAXWELL owes A.M. LONG & B.H. PHIPPS. ?? 1873 In the matter of a dispute between George T. REEVES & Jacob HOPPERAS [HOPPERS]. The Superior Court referred the case to J.W. TODD & Quincy F. NEAL in fall term 1873, who "now report our undertaking in the case & our conclusions of law thereon." David MAXWELL obtained a grant for 3,000 acres in 1837 [DB 11:346] covering the land in dispute, & also shows possession of a part of the 50 acre tract, but of the land in dispute, HOPPERAS obtained a grant in 1840 [DB 1:514] & thirty years ago also cleaned about 20 acres that has been in actual adverse possession ever since. Our conclusion is that HOPPERS have part of the interference lappage to the boundary of the 300 acre tract & REEVES having no actual possession of any part of the interference, HOPPERS' title has refined into good title he having had actual possession of part of the lappage for more than 7 years.
